Police also don't have to read drivers their Miranda rights 3 times anymore -- just once. There is mandatory counseling for D.U.I offenders. Underage drivers can be suspected based now on "reasonable suspicion" rather than the old standard of "probable cause." That gives officers more flexibility. The penalty also goes up for refusing a breath test to 6 months license suspension for the first offense, where it used to be only 3 months.. Each year alcohol contributes to about half the State's traffic fatalities according to the South Carolina Highway Patrol. Hopefully these new measures will drop that statistic drastically.

First time offenders with a .08 to .10 blood alcohol level will face a $400 fine and 48 hours of jail or community service. A .10 to .16 demands a $500 fine and 3 days in jail or community service. And a .16 and above will mean $1,000 fine and 30 days jail or service.
